The Supreme Court of Canada has decided it is OK to be in a vehicle with the engine running if you are drunk -- just as long as you're not likely to drive. It has acquitted a Quebec man convicted of impaired driving after he was found drunk behind the wheel of his idling truck. The man was waiting for a taxi but he felt cold and turned on the engine. In a 6-1 decision, the justices say the initial trial judge was right to acquit Donald Boudreault. An appeal court later convicted him. The ruling could have an impact on cases where people have been charged with being in "care and control" of a motor vehicle while impaired.
