Updating Your Will During The Pandemic

The Province has issued a new Emergency Order pertaining to the execution of Wills and Powers of Attorney, the changes are expected to help streamline the process.

WOODSTOCK - There has been a surge of frontline workers wanting to amend their Wills and Powers of Attorney during the pandemic.

The Province has issued a new Emergency Order pertaining to the execution of Wills and Powers of Attorney.  

Local Family Lawyer Sandra Carnegie says that technology has played a major role in these changes.

"The order extends the use of audio-visual communication technology for the signing and witnessing of Wills and Powers of Attorney, it also now allows those Wills and Powers of Attorney to be signed and witnessed on separate documents."

The new order allows the signing parties to be distanced from each other and the signatures can be on separate documents.  

Previously all three signatures required had to be on the same document.

Carnegie says these changes will help to maintain physical distancing guidelines and it is more efficient.

"This change reduces the number of times the parties need to be present on a video conference to execute and witness the Will and Powers of Attorney as that can now be done in one meeting."

Once all parties have signed off on separate documents, all of them should be gathered and compiled as soon as possible.
